iPhone 5: Samsung, Apple wants to sue them for LTE

In little more than 34 hours Apple will unveil the iPhone 5 officially. The expectations could not be higher, and it is nothing less than the biggest upgrade in the iPhone history awaits. One of the highlights of the expected global support faster mobile network to LTE standard will represent. The competition and especially Samsung of course this is an eyesore. The South Korean company had in fact only recently suffered a crushing defeat, but already plans to the appropriate counter.

An anonymous Samsung manager has informed divided on Monday over the Korea Times that the South Korean company will take action against the new generation of iPhones, if the device is equipped with a fast LTE. According to the source would like Samsung in the U.S. and Europe take legal action against the iPhone 5. Such an announcement was published two weeks ago in the newspaper, but apparently Samsung would like to stir up some more dust and even more times a day before the performance influence the media.

“It’s true that Samsung Electronics has decided to take immediate legal action against the Cupertino-based Apple. Countries in Europe and even the United States – Apple’s home turf – are our primary targets “.

Samsung holds with 819 relevant patents for the largest share (nearly 12.5 percent) of global LTE technology, Apple again can boast only with 434 LTE patents. It’s still questionable whether the South Korean company can ever enforce the patents. Because in the past, for example UMTS patents are not successful because they are classified as known, FRAND patents and must accordingly be offered on fair terms of competition. It is therefore currently not sure if a court ever permitted by the patents from Samsung for a method or arrange an amicable settlement on the FRAND principle.

“Apple claimed the existing 3G-related patents are standards-essential patents (SEPs), according to our earlier commitment to the FRAND (fair, reasonable, and non-discriminatory) terms. But the story is totally different when you talk about LTE patents. These are new and highly-valued, “said another Samsung executive.

Moreover, has the maker Qualcomm, which likely draws the LTE chip for the iPhone 5, a number of LTE patents that Apple licensed with the purchase of course also at the same time. Thus, Apple could wriggle out of. So far, the course pure speculation, and even Samsung does not know one hundred percent that the new iPhone will ever come to market with LTE.

We will learn the whole thing on the morrow. All further information, images and other facts can be viewed on Wednesday by 19 German time clock on our live ticker.
